Definitions
“Company”, “We”, “Us”: Refers to Infotigo IT. --- “Client”, “You”: Refers to the business or individual purchasing our services or using our website. --- “Service”: Refers to the software development, SaaS products, website design or marketing services provided by Infotigo IT.
Services and Engagement
Custom Development: For custom software projects, the specific scope of work, timeline, and deliverables will be outlined in a separate proposal or contract. SaaS Products (Restogo, EMS, etc.): We grant you a non exclusive, non transferable license to use our software for your business operations. You may not resell, reverse engineer or copy our source code without written permission.
Payments and Refunds
Payment Schedule: Unless otherwise agreed in a specific contract, a 50% advance payment is required to begin any custom development project. The remaining 50% is due upon project completion and before the final handover of credentials. Subscriptions: For monthly software subscriptions (e.g., POS or ERP), fees must be paid by the 5th of every month. Failure to pay may result in temporary suspension of your service.
Refund Policy
Services: Once work has commenced on a custom project, the advance payment is non-refundable to cover our team's time and resources. Software: We offer a free demo before purchase. Therefore, software license fees are generally non refundable once the license key or access has been issued.
Client Obligations
You agree to provide all necessary assets (logos, content, server access) required for us to complete your project on time. You agree not to use our software for any illegal activities under the laws of Bangladesh.
Intellectual Property Rights
Our IP: Infotigo IT retains all ownership rights to the core code, libraries, and proprietary tools used to build your project, unless a “Work for Hire” agreement transfers full ownership to you. Your IP: You retain full ownership of your business data, customer lists, and specific branding materials uploaded to our systems.
Limitation of Liability
To the maximum extent permitted by law, Infotigo IT shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services (e.g., loss of profits due to server downtime or internet issues). Our total liability shall not exceed the amount you paid to us for the service in the last 2 months.
Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, if you breach these Terms (e.g., non-payment or Any Criminal Activities). Upon termination, your right to use the Service will immediately cease.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Bangladesh..
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
